In “Appeals Court Hearing on Death Sentence for Mumia Abu-Jamal” (WV No. 966, 8 October), we wrote, referring to a November 9 hearing to be held by the Third Circuit Court of Appeals in Philadelphia, “The new hearing is a result of a January U.S. Supreme Court ruling that vacated Yohn’s decision, which had been previously upheld by the Third Circuit.” In fact, the Supreme Court decision did not vacate Judge William Yohn’s 2001 decision, which overturned Mumia’s death sentence while upholding his frame-up conviction. It vacated the Third Circuit’s March 2008 ruling that had upheld Yohn’s decision. In the upcoming hearing, the prosecution is seeking to reinstate Mumia’s death sentence.
